General Conditions of Cable Transportation

Article 1. Scope of Application
The contract for using the ski area operated by the Company (the “Ski Area”) shall be governed by the provisions of these General Conditions of Use. Matters not stipulated in the General Conditions of Use shall be governed by laws and regulations or generally established customs.
Article 2.Instructions by Staff Members
Whenever necessary for the safe transportation of passengers and the maintenance of order, the Company’s staff members (“Staff”) will give instructions to passengers, and passengers have to comply with such instructions. (Provision of transportation service)
Article 3.Instructions by Staff
The Company undertakes to provide transportation of passengers unless such service is refused pursuant to the provisions of Article 4.
Article 4.Refusal to Provide Transportation
The Company shall refuse to provide transportation of a passenger in any of the following cases:
- If the passenger does not have a valid boarding pass;
- If the passenger does not follow the instructions of Staff;
- If the passenger requests any special burden in connection with such transportation;
- If such transportation is contrary to the provisions of laws and regulations, public order, or good morals;
- If the passenger’s condition or other factors make it impossible to ensure safe transportation:
- If the passenger is in possession of dangerous goods;
- If there is an impediment to transportation due to a natural disaster or other unavoidable reason; and
- If there is any justifiable reason other than those listed in the preceding items.
Article 5.Ticket Sales
The Company sells tickets at ticket counters.
Article 6.Validity of Tickets
Tickets shall be valid only when used under the conditions stated on the ticket.
- If the Company changes the fare or fee, a ticket that had been issued before the change shall be valid for the period of validity regardless of the amount of the fare indicated on the ticket.
- If a ticket other than valid tickets issued by the Company is used, it shall be deemed invalid.
- Tickets shall be invalid if they fall under any of the following items:
- If a ticket is used without complying with the conditions stated on the face of the ticket;
- If a season pass is used by a person other than the bearer of the season pass;
- If a ticket is used after being modified, altered, or forged; and
- If a ticket with illegible information on the face of the ticket is used.
- The ticket is valid for use only by the customer who purchased it. The ticket may not be given or sold to another person, in which case it will be deemed invalid and will be collected.
Article 7.Presentation of Tickets
The Company shall require a passenger to present their ticket at the time of boarding and shall check, clip, or collect it depending on the type of ticket.
Article 8.Fares, Fees, and Method of Collection
Fares and fees to be collected by the Company from passengers and the method whereby it is collected shall be in accordance with the Fare Table published separately and the method of collection separately provided for.
Article 9.Handling of Passengers during Transportation in case of Suspension of Operation
In case the cableway operation is suspended due to a disaster or other unavoidable reasons, necessary measures for continued transportation, such as free issuance of valid tickets, shall be taken for passengers after operation has been resumed.
Article 10.Refund of Fares
If the cableway cannot be operated due to a natural disaster or the Company’s responsibility, a refund will be made in accordance with the provisions separately stipulated. However, this shall not apply when the operation is temporarily suspended due to danger of the operation caused by wind and snow.
Article 11.Commencement and Termination of Liability
The Company’s liability for transportation shall begin when a passenger performs the acts set forth in Article 7 and shall end when they disembark from the cableway.
Article 12.Prohibited Acts by Passengers
Passengers shall not engage in any of the following acts:
- Jumping down from a carrier or getting on or off a carrier in a position other than the designated one;
- Shaking the skis or the carrier;
- Poking the cableway facilities with skis, poles, and the like;
- Riding sideways or in other dangerous positions; and
- Engaging in any other conduct that interferes with safe transportation.
Article 13.Liability for Passengers
If a passenger’s life or body is injured by the operation of the cableway, the Company shall be liable to compensate for the damage caused thereby. However, this shall not apply in the following cases:
When it is proved that the Company was not negligent concerning the attention prescribed in the law in connection with the operation of the cableway and that there was not a defect or functional failure of the cableway facilities; and when it is proved that the accident was caused exclusively by the passenger’s willful misconduct or negligence.
Article 14.Liability for Personal Effects
The Company shall not be liable to compensate for any loss of, or damage to, skis or other personal effects arising out of or in connection with the transportation of passengers. However, this shall not apply if the loss or damage was caused by the Company’s negligence.
Article 15.Liability of Passengers
In the event that the Company suffers any damage due to a passenger’s willful misconduct or negligence or failure to observe laws and regulations or the Conditions of Transportation, the Company shall demand compensation from the passenger for such damage.
Article 16.Surcharges
If a ticket held by a passenger is declared invalid pursuant to the provisions of Article 6, paragraphs 3 and 4, the Company shall charge the passenger an amount equivalent to the ticket and a surcharge of not more than the same amount as that of the ticket.
